The FCC’s Order in Docket 10-90, effective on Dec. 29, 2011, initiates a multi-year reform of the nation’s woefully inadequate and out-of-date system of carrier-to-carrier payments for carrying traffic. At first, the Order seeks to reform only terminating traffic – and in the process solve two industry bugaboos: “traffic pumping” and “phantom traffic.” But ultimately, the Order will also address originating access and per minute transport charges for all carriers. The Order’s scope is far-reaching and its impact is profound – and some stakeholders believe it is fundamentally flawed.
