FCC Docket No. 10-90 – Major Carrier Dispute for 2013 – When Can CLECs Assess End Office Local Switching Charges

The disagreement between AT&T on one side and Level 3 and Bandwidth.com on the other is heating up at the FCC. The dispute involves whether AT&T must pay switched access local switching charges to these CLECs for calls in which the CLECs partner with “over-the-top” VoIP providers to route calls over the public Internet to the VoIP provider’s end users. This is a very significant case, not just because the money involved is considerable, but  ...

Docket 10-90 – As a Formal Proceeding Begins, CLECs Attack AT&T’s Petition Requesting the FCC to Mandate the Retirement of All TDM-Based Services/Networks and Transition to an IP-Based Network

In the opening skirmish in what may be the most contentious proceeding in 2013, CLECs Cbeyond, Earthlink, Integra Telecom and Time Warner Telecom (“the CLECs”) have filed a response to the 2012 AT&T petition that requested the Commission to initiate a proceeding to develop a course of action to eliminate ...

Docket 06-122 - Carriers Protest the Commission’s Clarified Reseller Rules for Universal Service Contributions

TelePacific has filed a Petition seeking partial reconsideration of the November 5, 2012, FCC Order in Docket 06-122 clarifying how the universal service rules apply to wholesale providers and their customers. In that Order, the Commission clarified that “reseller” certification is required on ...

FCC Docket 05-25 – Special Access Report and Order and Further Notice of Proposed Rulemaking

Remember, back on August 22, 2012, the FCC released a Report and Order (Order) in Docket 05-25 temporarily suspending new grants of special access pricing flexibility to ILECs, while it conducted a market analysis into how special access should be priced in the future. The Commission stated at that time that within 60 days it would release a comprehensive special access data request to begin the analysis. Well better late than never! Unsurprisingly, the Commission failed to issue the data request within 60 days, but finally did so on December 18, 2012. Along with the data request, the Commission issued a Further Notice of Proposed Rulemaking (FNPRM) seeking industry comments on the ...

United States Telecom Association (USTA) – Petition for Ruling that ILECs are Non-Dominant in Switched Voice Services

Speaking of 2013, one petition that is likely to spur industry debate in the new year and beyond is a December 19, 2012 Petition by USTA seeking to begin a dialogue regarding the removal of "archaic" regulation for ILEC plain old telephone service (POTS). The association contends that as more and more households use VoIP and wireless services for their everyday communications needs, it is patently unfair to ILEC s that ...

Colorado – “Telecom Rulemaking in Response to Technology &/or Markets”, Docket No. 12R-862T adopted November 20, 2012 – Updated December 17, 2012.
https://www.dora.state.co.us/pls/efi/EFI.Show_Docket?p_session_id=&p_docket_id=12R-862T

The Colorado Department of Regulatory Agencies (DORA) has issued an order for Docket 12R-862T regarding changes to its rules to allow for competitive telecommunications regulations within the state of Colorado. Beginning in 2013 the PUC will initiate a review to determine where effective competition exists within the state for basic telecommunications services. Where effective competition is determined to exist, then basic telecommunications services, with the exception of switched access or emergency services will be regulated under Part III rules, meaning that the carrier are not required to follow the commission tariffing rules.

IP enabled services and VoIP providers are determined to be deregulated except for emergency services. In addition, IP enabled services and VoIP providers must pay into the 911, Low Income Telephone Assistance Program, Telephone Relay Service, HCSM and Fixed Utility Fund programs.

AT&T Requests FCC to Facilitate Retirement of TDM-Based Services/Networks and the Transition to an IP-Based Network

AT&T has filed a petition with the FCC requesting the Commission to initiate a proceeding to develop a course of action to eliminate the requirement that carriers interconnect using their Time Division Multiplexing (TDM) networks. Instead, carriers would interconnect utilizing Internet Protocol (IP) based networks only. Moreover, interconnection prices, terms and conditions would be developed through carrier negotiations without following the 1996 Telecom Act section 251 requirements. According to AT&T, these actions would enable carriers to retire their TDM networks on a timely basis. Specifically, AT&T requests the Commission to take the following actions ...

FCC Clarifies Reseller Rules for Universal Service Contributions

On November 5, 2012, the FCC issued an Order in Docket 06-122 clarifying how the universal service rules apply to wholesale providers and their customers. Under the current rules, wholesale carriers generally do not contribute to the universal service fund for the services that include the wholesale service (typically called carrier’s carrier revenues), but may be required to contribute on revenues earned from sales to customers that do not contribute to the Fund (end user revenues). In recent years, however, there have been disputes regarding how to comply with this rule and the Universal Service Administrative Company (USAC) has asked for Commission guidance. In this Order, the FCC provides such guidance. It states the following ...
